These Terms and Conditions ("Terms") govern your use of the website homesay.in and the services provided by HomeSay Technologies India ("HomeSay", "we", "us" or "our"). By accessing our website, requesting a quotation, booking a service or making a payment, you agree to be bound by these Terms.
1. Services Offered
HomeSay provides home improvement services across Delhi NCR, including interior and exterior painting, enamel work, wood polishing, waterproofing, false ceiling, wall moulding, modular kitchens, wardrobes, TV units, designer beds, pooja mandirs and bathroom renovation.
Service availability depends on your location and our capacity at the time of booking. We serve Delhi, Gurgaon, Noida, Greater Noida and Faridabad. We reserve the right to decline a booking that falls outside our service area or capability.
2. Quotations and Estimates
- Prices shown by our online price calculator are indicative estimates only, generated from the area and service type you enter. They do not constitute a binding offer.
- A binding price is confirmed only in a written quotation issued after a site inspection.
- Final cost may differ from the estimate based on actual site conditions, surface preparation required, material selection, quantity of work and site accessibility.
- Quotations are valid for 15 days from the date of issue unless stated otherwise.
3. Booking and Scheduling
- A booking is confirmed when we acknowledge it in writing and, where applicable, receive the advance payment.
- Work schedules are planned in advance and communicated to you. Timelines are good-faith estimates and may be affected by weather, material availability, site readiness or factors beyond our control.
- You agree to provide safe and reasonable access to the premises during agreed working hours, along with access to water and electricity as required for the work.
- You are responsible for moving or protecting valuables, fragile items and personal belongings from the work area before work begins, unless separately agreed in writing.
4. Pricing, Taxes and Payment
- All prices are in Indian Rupees (INR).
- Goods and Services Tax (GST) applies at the prevailing statutory rate and is charged in addition to quoted amounts unless the quotation expressly states that it is inclusive.
- A GST invoice is issued against our GSTIN 07FKMPP2713L1ZP.
- Payment terms, including any advance and milestone payments, are set out in the written quotation.
- Online payments are processed through Cashfree Payments. We accept the payment methods supported by the gateway, including UPI, debit and credit cards, net banking and wallets.
- The balance is payable on completion and handover of the work unless agreed otherwise in writing.
5. Payment Processing
Online payments are handled by Cashfree Payments, a payment aggregator authorised by the Reserve Bank of India. HomeSay does not store your card number, CVV, UPI PIN or net-banking credentials.
If a payment fails but the amount is debited from your account, the amount is normally reversed automatically by your bank or the payment gateway within 5 to 7 working days. If it is not, contact us with your transaction reference and we will assist in tracing it.
6. Workmanship and Materials
- Work is carried out in a professional manner using materials of the grade specified in the quotation.
- Where you supply your own materials, we are not responsible for defects, colour variation or failure arising from those materials.
- Minor variation in colour, shade, texture and finish is inherent to painting, polishing and handcrafted work and does not constitute a defect.
- Product warranties on paints, hardware and fittings are those offered by the respective manufacturer and are passed through to you. HomeSay is not the warrantor of third-party products.
- Any workmanship warranty offered by HomeSay, and its duration, will be stated in the quotation or invoice.
7. Customer Responsibilities
- Provide accurate information about the property, the work required and site conditions.
- Obtain any permissions required from your building society, landlord or RWA before work begins.
- Ensure the site is vacant and ready as agreed on the scheduled start date.
- Raise any concern about the quality of work promptly, and in any case before final handover, so it can be inspected and addressed.
8. Cancellation and Refunds
Cancellation of bookings and the treatment of refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms.
9. Limitation of Liability
- Our total liability in connection with any service is limited to the amount actually paid by you for that service.
- We are not liable for indirect, incidental or consequential loss, including loss of profit, loss of use or loss of opportunity.
- We are not liable for pre-existing defects in the property, including damp, structural cracks, seepage or defective plaster, or for the recurrence of such defects after our work.
- We are not liable for delay or non-performance caused by events beyond our reasonable control, including weather, strikes, civil disruption, government restrictions or unavailability of materials.
10. Intellectual Property
All content on this website — including text, graphics, logos, photographs, designs and the HomeSay name and mark — is owned by or licensed to HomeSay Technologies India and is protected under applicable intellectual property law. You may not reproduce, distribute or use it commercially without our prior written permission.
We may photograph completed work for our portfolio and marketing. If you do not wish your property to be photographed or featured, tell us in writing and we will respect that.
11. Website Use
You agree not to use this website for any unlawful purpose, not to attempt unauthorised access to any part of it or its systems, and not to interfere with its operation. We may suspend or withdraw access to the website without notice.
The website is provided on an "as is" basis. While we take care to keep information accurate and current, we do not warrant that it is free of errors or that the website will be uninterrupted.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts at Gautam Buddh Nagar, Uttar Pradesh.
Nothing in these Terms limits any right available to you as a consumer under the Consumer Protection Act, 2019.
13. Changes to These Terms
We may revise these Terms from time to time. The current version is always available on this page with the date it was last updated. The Terms in force at the time of your booking apply to that booking.
